I cannot speak to the laws of other states, but my state severely restricts the authority of a fire marshal (if the locality even has one).

The only time they can enter a private building used as a dwelling is after a fire, or with consent of the occupant or with an inspection warrant (similar to a search warrant).

I've met several good fire marshals and arson investigators, and the good ones understand the law, the limits of their authority and their function. But I've also met a few that were 100%, total, SQUIRRELS that had exaggerated beliefs about their authority and function.
